Dushyant Dave says abrogation exercise was “bereft of any reasons”, prompting the CJI to ask if petitioners wanted the SC to review the basis of the Centre’s decision to repeal the provision
The Supreme Court, hearing a series of petitions against the abrogation of Article 370, said that its ambit lay in investigating whether the repeal of the provision in August 2019 amounted to a “constitutional violation”.
The Supreme Court on Thursday appeared unenthusiastic to accept an “invitation” to judicially review the “wisdom” behind the Union government’s decision to abrogate Article 370, which had given a special status to Jammu and Kashmir.
Instead, the Constitution Bench said that its ambit lay in investigating whether the repeal of the provision in August 2019 amounted to a “constitutional violation”.

"The exercise of abrogation is a complete fraud on the Constitution. In the BJP manifesto, they had promised abrogation, and this Court had ruled that these manifestos cannot be against the constitutional scheme and spirit. Now because you have majority in Parliament, you have done this and it is all because you told people to vote for you and you will abrogate it. This shows power exercised for colourable considerations. President is not a rubber stamp; majority does not speak, it is not a constituent power."
After Dave concluded, Senior Advocate Shekhar Naphade began
his submissions for the petitioners.
He said that the Presidential proclamation leading to the
abrogation was "clearly without jurisdiction," since the Governor had
already dissolved the assembly and assumed all powers of the State.
"This
assuming of power will not mean breakdown of law and order machinery. This is a
jurisdictional issue and Article 356 has been invoked for a collateral purpose
and the collateral purpose is apparent on the face of the record. The J&K
Reorganization Act is born in unconstitutionality."
At this point, CJI Chandrachud asked what happens when one
unites two States.
J&K did not completely integrate with
India
Shah
reiterated submissions he had made towards the end of yesterday that although
J&K “unconditionally acceded” to India through the
Instrument of Accession, it did not “integrate” with India since no “merger
agreement” was executed.
He further added that the powers subsumed in
Article 370 can either be termed as “sovereign or residuary” powers.

According to the written document, Article 370 was the basis of the relationship between India and Jammu and Kashmir, as if it had the status of a moment.
Now we are told that Article 370 was temporary as if there was a temporary relationship between India and Jammu and Kashmir.

The status of the state was also analyzed, the article under which the relationship of the state was linked with secular India, you abolished it.

Threats to Muslims in front of Delhi police station, video of Hindutva leader's hateful speech viral on social media

It reached such an extent that in front of Delhi's police station, a Hindutva leader was openly threatening Muslims and no action was taken by the police during this period. That didn't stop him from making such hate speech.
According to the details, a video went viral on social media in which it can be clearly seen that a Hindu extremist leader is making a hate speech in front of the Nangloi police station. He is asking his supporters to boycott Muslims and is threatening Muslims. He is asking people to force Muslims to flee from here as in Uttarakhand and not to buy from their shops and to force Muslims living in rented houses to vacate their houses.

Article-370: The Supreme Court of India rejected the Government of India's argument saying that it would make its decision on constitutional grounds.
So according to you
first Kashmiris have to engage in militant attacks ,azadi marches and
stone-pelting and subsequent to that lose a hundreds and thousands lives and
only then our protest will be registered? It’s unfortunate how people knowingly or
unknowingly are incentivizing violence in Jammu and Kashmir.

boycott of separatists. On that I think Article 370 was not even a
issue of separatists and militants. In their own words it was a
‘foreign article of a foreign constitution’. They never recognized the
legitimacy of the accession or the constitution of India or for that matter
even CONSTITUTION OF JAMMU AND KASHMIR. Why would they be bothered by ABRROGATIONOF ARTICLE 370?
If you any doubts
regarding the disapproval of 5 Aug 2019 by JAMMU AND KASHMIR CITIZENS then
please look at the recent DDC elections results. It was the first electoral exercise after 5
Aug 2019 and PAGD- People's Alliance for Gupkar
Declaration won entire Kashmir and even won 35 seats in Jammu. Poor BJP could
only secure half of Jammu. This essentially means that the majority of
J&Kites are against 5 Aug 2019. Or if this doesn’t suffice then please come
to J&K and speak to every section of J&Kites and find out the truth for
yourself. Go ahead do a survey!
Now over the issues of
militancy. I don’t believe militancy has decreased post 5 Aug 2019.
There have been many militant attacks post 5 Aug 2019, their own BJP workers
got killed in these incidents. Even they admitted that they are not allowing 4G
because of ‘security concerns’. It was only after more than 500 days or so they
allowed 4G. The number of militant incidents might have decreased by a slight
margin but I am sorry that’s half news because the recruitment of militants
increased post 5 Aug 2019.[5]BJP often sells half baked truths for their electoral gains.
They always sell their agenda by something on the pattern of “We killed X
number of militantss” but they never give you an account of “X number of
Kashmiris joined militant ranks due to disillusionment caused by our policies”

Srinagar: Senior Vice President of Awami National Conference Muzaffar Shah, while commenting on the announcement by the Lieutenant Governor to give houses to two and a half lakh homeless families in Jammu Kashmir, said that according to the Parliament, only 19 thousand people are homeless in Jammu Kashmir. To whom are the remaining houses being given? Speaking to the media in Srinagar, Muzaffar Shah said in a questioning manner, in response to a question in Parliament in 2021, it was said that according to the census, only 19 thousand families are homeless in Jammu and Kashmir. He said that the Lieutenant Governor announced the previous day that houses will be given to two and a half lakh homeless families in Jammu and Kashmir, in which 145,000 families were also approved. Muzaffar Shah said that if only 19,000 families are homeless in Jammu and Kashmir, then to whom are the remaining houses being given? He said that some more families may have increased in the last two years, but the people of Jammu and Kashmir have doubts about the number of 250,000. While saying that only the Pashtun residents of Jammu and Kashmir should be provided with houses. Shah said that people are in doubt in this matter and want the government to remove this doubt. Muzaffar Shah said that Article 370 has not been completely abolished in Jammu and Kashmir, but the matter is still in the court, so the authorities should not take such decisions which are not within their jurisdiction, but the people's government should take their decisions.
